J&K&L High Court Denies Cooperative Department Employees’ Request To Work Until 60

The J&K&L High Court recently heard petitions from employees of the cooperative department who were seeking permission to work until the age of 60. They also requested the court to quash the order that required them to retire at the age of 58. The court concluded that the employees of the cooperative department are governed by SRO 233 of 1998. This rule is a common service rule for cooperative institution employees, and its provisions occupy the field. Therefore, unless there is any alteration or modification of the provisions of SRO 233 of 1998 by competent authority through a procedure recognized under law, the petitioners cannot claim to remain in service of the respondents up to the age of 60 years under any circumstances. This includes the strength of SRO 164 of 2014, and as such, the employees of cooperative department have to retire at the age of 58 years.
